These Program T&Cs govern your submission of information, your access to and use of information or programs, and your procurement of product through the YUVEZZI Program. By acknowledging and agreeing to these Program T&Cs, accessing or using information or programs through the YUVEZZI Program (“YUVEZZI Program” or “Program”), or submitting a purchase order through the Program, you represent that you have the authority and means to bind the practice location and individuals working therein, and you agree, to fully comply with the Program T&Cs, as they may be modified or supplemented here from time to time by Tenpoint Therapeutics without other notice to you. As used herein, the terms “you,” “your,” and “user” encompass the practice location ordering YUVEZZI and the individuals working at or on behalf of the practice location ordering YUVEZZI.
By accessing or submitting information to the Program, you consent to Tenpoint Therapeutics Ltd.’s (“Tenpoint” or “Tenpoint Therapeutics”) collection and use of your information in accordance with the company’s Privacy Policy.
If you attempt to and/or register for the YUVEZZI Program, you warrant that all information you submit is accurate and complete and you have the authority to disclose and submit the specific information. You further warrant that, prior to any subsequent use of the YUVEZZI Program, you will notify Tenpoint at HCPSupport@tenpointtx.com in the event your submitted information has become inaccurate or incomplete. Tenpoint reserves the right to limit or cancel your registration for the YUVEZZI Program due to inaccurate, incomplete, or other informational concerns. Please contact HCPSupport@tenpointtx.com if you have questions about your account or the status of your account or any submissions or orders.
When you submit an order for YUVEZZI through the Program, you warrant that (i) you are a qualified, licensed healthcare professional authorized under applicable state and federal laws to purchase, prescribe, dispense, and distribute YUVEZZI; (ii) you expect to retain this status at the time the product is distributed to you, and (iii) the submitted information identifies a location at which you are legally authorized to receive a prescription drug product under applicable laws. Tenpoint retains the right to seek additional information or to cancel an order if there is a question about your legal authorization to receive YUVEZZI. You further warrant that you are authorized to order and purchase YUVEZZI in accordance with any applicable institutional or other restrictions and policies that apply to you. By submitting an order to purchase YUVEZZI, you warrant that you will pay amounts due in full by credit card for the product at the time you submit the order. Financial processing will be handled through a secure third-party vendor. Tenpoint will only ship orders after funds have cleared for payment.
Advertised Price Policy (“APP”): While HCPs are authorized to advertise YUVEZZI, and to sell YUVEZZI at any price they deem appropriate, it is a violation of this Policy for an HCP to advertise a YUVEZZI price below the manufacturer’s suggested retail price floor of $79.00 per 30-day supply. However, HCPs and their practices remain free to advertise that a customer may “call for price”, “text for price”, or “email for price.” Tenpoint Therapeutics reserves the right to limit or cancel your registration for the YUVEZZI program in the event that it deems you have been or are in violation of the APP.
If you are employed by or acting in collaboration with an organization, institution, or governmental entity, you warrant that you are authorized to participate in the Program, and to order and procure YUVEZZI in accordance with any applicable policies, authorities, and limitations that may apply to you.
Generally, returns are not permitted. Any questions about an order or perceived deficiency in an order must be reported within five (5) business days of the order’s receipt to Tenpoint Therapeutics at HCPSupport@tenpointtx.com or through the PharmaRx ordering portal. Provide all supporting evidence about any perceived deficiency with the initial communication.
YUVEZZI Program users must comply with all applicable laws related to that persons’ duties and responsibilities under these T&Cs and any other applicable agreement(s). Users are responsible for maintaining all documents and take all additional steps necessary to facilitate compliance with applicable laws and regulations. Program users acknowledge that they are solely and exclusively responsible for accurately reporting prices or other information to government agencies and other entities, as applicable.
